General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions apply to all purchase contracts concluded with Mulberries Technology Limited via the www.mangosteenebike.ch. They apply exclusively to customers in Switzerland. Deviating provisions are only recognised if they have been confirmed in writing by mangosteenebike.ch. mangosteenebike.ch is entitled to amend or delete these General Terms and Conditions at any time. These General Terms and Conditions are deemed accepted if the customer does not object within 30 days. 2. Registration
Registration in the webshop is free of charge and is reserved exclusively for persons with legal capacity. The data required for registration must be provided truthfully and completely. The customer is responsible for keeping his data up to date. There is no entitlement to admission to the webshop. The customer is solely responsible for content that he places in areas accessible to him. Such content must not infringe the rights of third parties. There is no entitlement to publication or storage of the posted content. Each customer is entitled to maintain only one customer account at the same time. www.mangosteenebike.ch reserves the right to delete multiple registrations and to warn or terminate customers who violate the registration conditions or to delete or modify content (virtual house right).
3. Newsletter
Registration for the newsletter is optional. A newsletter may be sent several times a year to the e-mail address provided during registration. The customer can unsubscribe from this newsletter at any time by clicking on the corresponding link.
4. Conclusion of Contract
4.1 The product range on www.mangosteenebike.ch is non-binding. Price and range changes as well as technical changes remain reserved at all times. All offers are subject to change and are not to be understood as binding offers. All information onwww.mangosteenebike.ch such as product descriptions, illustrations, films, dimensions, weights, technical specifications and other details are to be understood only as approximate values and in particular do not constitute a guarantee of properties.
4.2 Orders are placed exclusively online via the webshop. Orders are confirmed by e-mail. A contract between the customer and www.mangosteenebike.ch is only concluded upon this order confirmation. The automatic order receipt confirmation sent by the webshop system by e-mail does not constitute an order confirmation. www.mangosteenebike.ch reserves the right not to accept an order – for whatever reason – and to refuse confirmation. www.mangosteenebike.ch endeavours to align the scope and execution of the delivery with the wishes stated in the order. However, only the terms stated by www.mangosteenebike.ch in the order confirmation (product characteristics, price, shipping and ancillary costs) are binding. By placing the order, the customer confirms the accuracy of all information provided by him.
4.3 Despite the greatest care, incorrect information cannot be completely ruled out. All price information is non-binding. Price changes can be made at any time and without prior notice. For various reasons, it may exceptionally happen that insufficient goods are available or cannot be released for delivery. www.mangosteenebike.ch is not liable for unavailable products or incorrect price information. Model changes remain reserved. Timed offers are only valid for the specified period. All prices include Swiss VAT. No extra charges at delivery. If an item cannot be delivered despite being charged, the corresponding amount will be fully refunded to the original payment method. There is no subsequent delivery and no claim for damages.
5. General Payment Terms
5.1 Depending on the shipping method, www.mangosteenebike.ch provides various means of payment. For each order, www.mangosteenebike.ch reserves the right to decide at its own discretion which means of payment it accepts.
5.2 Only payments from accounts within Switzerland are accepted. Any transaction costs shall be borne by the customer.
5.3 Purchase on account with instalment option (Klarna)
Klarna offers the payment method “purchase on account” as an external payment service provider. With the single invoice you can simply pay for your online purchase by invoice. If you waive payment within the specified period, you will subsequently receive a monthly invoice with an order overview in the following month.
Upon conclusion of the purchase contract, Klarna assumes the resulting invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept the AGB of Klarna in addition to our AGB (https://www.klarna.com/ch/agb/).
6. General Delivery Terms
6.1 The delivery of the ordered goods is carried out by the delivery service commissioned by us to the address specified by the customer under the conditions stated in the order confirmation. Depending on the product size, delivery is made by the partner delivery service of www.mangosteenebike.ch or by various delivery partners (Post, forwarding agents). www.mangosteenebike.ch is generally entitled to make partial deliveries.
6.2 The indication of a delivery date is made to the best of our knowledge but without guarantee. In the event of delivery delays, the customer will be informed immediately. In the event of final unavailability of the ordered items, payments already made will be refunded. www.mangosteenebike.ch is not liable for delivery delays caused by manufacturers or third parties. Failure to meet the delivery deadline does not give the customer any right to withdraw from the contract or claim damages. In the event of final unavailability, the customer has no claim for damages.
6.3 Ownership and risk of the goods pass to the customer upon handover at the delivery address.
6.4 If handover of the goods cannot take place for reasons for which the customer is responsible (e.g. incorrect or incomplete address, absence at the time of delivery, refusal of acceptance without justified reason, etc.), the costs incurred as a result (e.g. return shipment, redelivery, etc.) will be charged to the customer.
6.5 If goods are delivered with obvious damage to the packaging or contents, the customer must complain to the carrier/parcel service provider immediately and refuse acceptance. Any visible or hidden transit damage should be reported to our customer service at service@mangosteenebike.ch within 7 days of delivery with supporting photos. All transport damage must also be reported to www.mangosteenebike.ch immediately.
7. Shipping Costs
The amount of shipping costs depends on the purchased products, the order value and the shipping method. Please refer to the Shipping Policy for specific details.
8. Warranty
Beyond the initial 30-day return window, www.mangosteenebike.ch grants a 1-year warranty from the date of purchase or home delivery for defects that are clearly identified as manufacturing or material defects. Under the warranty period (for quality issues), we prioritize repairing or replacing parts. If the item cannot be repaired, we follow a 30-day return policy.The decision on the type of defect remedy lies with Mulberries Technology Limited.
Any warranty claims must be made via the contact form. A warranty claim can only be made if proof of purchase is available. Maintenance and care instructions for the battery must be observed. In the event of non-compliance with the conditions, www.mangosteenebike.ch reserves the right to refuse warranty services.
The warranty does not apply to wearing parts. Damage caused by improper handling, use or transport. Damage caused by the use of a non-original original charger. Damage caused by opening or damaging the charger housing, damage or malfunctions due to accidents, non-intended use, negligence or recognisable external damage. Technical modifications to the e-bike. Subsequent installation/conversion of non-compatible or non-original parts. Damage resulting from weather influences or the use of unsuitable cleaning agents, high-pressure cleaners or additives used.

The warranty obligation expires in the event of repairs by service centres not authorised by www.mangosteenebike.ch.
9. Product Liability
Product liability is generally excluded if a product of www.mangosteenebike.ch does not comply with the applicable regulations at the time of use, has not been placed on the market in accordance with the regulations or has not been used by www.mangosteenebike.ch in accordance with the regulations.
Specifically, any product liability is excluded in the following cases: Technical modification of the e-bike without the consent of www.mangosteenebike.ch. Subsequent conversion with non-compatible or original parts. Non-compliance with the service intervals specified in the operating instructions. Damage resulting from weather influences. Damage caused by the use of unsuitable cleaning agents, high-pressure cleaners or additives. Improper transport. Improper use. Improper maintenance. Missing or incorrect adjustment of components. Worn components. Use in racing or competition. Use for commercial rental or other commercial purposes. Deeply discharged battery due to prolonged non-use or failure to charge regularly (approx. every two months). Damage because the battery was exposed to very high (> 40 °C) or very low (< 5 °C) temperatures. Damage caused by short-circuiting the battery. Damage because the battery was placed in water. Liability claims by third parties are excluded in any case.
10. Right of Return
electric bicycles, Accessories and spare parts are subject to the legally mandated 30-day return period.
11. Disclaimer of Liability
Any claims of the customer other than those expressly granted in these General Terms and Conditions are excluded – irrespective of the legal grounds and to the extent permitted by law. This disclaimer of liability also applies in particular to the actions of contractual partners of www.mangosteenebike.ch, auxiliary persons, etc. as well as to all consequential damages, loss of profit or other financial losses of the customer.
12. Prohibition of Assignment
The customer may only assign his contractual rights to third parties with the written consent of www.mangosteenebike.ch.
13. Warranty of Data Communication
www.mangosteenebike.ch is not liable for the constant and uninterrupted availability of the webshop or for technical or electronic errors during sales transactions, in particular not for delayed processing or acceptance of orders.
14. Data Protection
14.1 All customer data collected is treated confidentially and in good faith. www.mangosteenebike.ch points out that the data recorded in the context of the conclusion of the contract is collected, processed and used to fulfil the obligations arising from the purchase contract. The data necessary for the provision of services and fulfilment of the contract may also be passed on to commissioned service partners (e.g. logistics companies, service partners, debt collection company). By agreeing to these GTC, customers declare their consent to this use of data.
14.2 www.mangosteenebike.ch is entitled to process data about the customer collected in connection with the business relationship within the meaning of the nFADP/revDSG/ GDPR.
15. Protection of Intellectual Property
The entire content of this website is protected by copyright. The storage or printing of individual pages and/or sub-areas of this website is permitted provided that neither the copyright notices nor other legally protected designations are removed. All property rights remain with www.mangosteenebike.ch. The complete or partial reproduction, transmission, modification, linking or use of this website for public or commercial purposes is prohibited without the prior written consent of www.mangosteenebike.ch.
16. Final Provisions
16.1 Should individual provisions of these GTC be wholly or partially invalid, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provisions shall be replaced by provisions whose content comes as close as possible to that of the invalid provisions. The same applies in the event of any gaps in the contract.
16.2 www.mangosteenebike.ch reserves the right to amend the GTC at any time. The GTC published in the webshop shall apply in each case.
